Joe Fraser Chartered Surveyors have a number of specialists who regularly produce Expert Witness reports for a range of disputes. All reports are produced in compliance with the RICS Practice Statement (4th Edition), and are compliant with the relevant protocol.
We are typically instructed to act as an Expert Witness or a Single Joint Expert under the Civil Procedure Rules, Part 35, and the Family Procedure Rules, Part 25. Other instructions include those for criminal matters and before the First-Tier and Upper-Tier Tribunal. We can also provide reports for boundary disputes or party wall matters.
What is an Expert Witness?
An expert witness has a duty to offer their expert impartial opinion to a Court or tribunal. They will create a report which will be offered in Court to support a case or tribunal.
- The Expert Witness Report is required by Court as the expert cannot back up their claims without it.
- The Report must contain truthful and impartial opinions.
- An Expert Witness Report will not contain advice – it will merely state the facts of the case and the opinions of the expert.
